DHAKA, Jan 15, 2020 (BSS) – From now on, no examinee of Primary Education Completion (PEC) and its equivalent Ebtedayee terminal examinations would be expelled as the Directorate of Primary Education (DPE) has withdrawn the expulsion order.
Acting director general at the Directorate of Primary Education Sohel Ahmed informed the government’s decision to the High Court bench comprising Justice M Enayetur Rahim and Justice Md Mostafizur Rahman appearing before the court today.
After hearing the HC bench disposed of its suo moto (voluntary) rule issued earlier and exonerated the acting DG from personal appearance before the court in connection with the rule.
Advocate AM Jamiul Haque Faisal stood for the writ petitioner while Deputy Attorney General Amit Talukdar represented the state. Shafik Mahmud stood for the DG.
The bench in a suo moto rule on November 21, 2019 ordered the authorities concerned to explain why the expulsion of children during PEC examinations should not be declared illegal.
The bench also asked why section 11 of the directives of the Directorate of Primary Education, issued in 2018, should not be declared illegal. This particular section had directions on taking actions for ‘breaching disciplines’. The children were expelled for allegedly adopting unfair means.
Lawyer AM Zamiul Haque brought the issue of PEC examinees’ expulsion to the court’s notice and sought directives in this regard when a national daily published a report about the expulsion of 15 children during the PEC examinations last year.
Later, the court ordered the authorities concerned to take examinations of the expelled students and publish their results by December 31.
To comply with the court’s order, the authorities concerned also took the examinations of the expelled students and published their results.
