Review verdict on life imprisonment tenure any day

DHAKA, July 11, 2019 (BSS) – The Appellate Division of the Supreme Court will pass judgment on plea filed to review its 2017 observation that had said life imprisonment means jail sentence until natural death of the convict.

The apex court kept the judgment on CAV, curia advisari vult (a Latin legal term meaning court awaits judgment), as the hearing in the case concluded today.

“Hearing concluded, Judgment CAV,” said the Appellate Division full bench headed by Chief Justice Syed Mahmud Hossain.

Earlier on April 11, the apex court appointed four senior jurists- Barrister Rokonuddin Mahmud, AF Hassan Ariff, Monsurul Hoque Chowdhury and Abdur Rezak Khan, as amicus curiae to help it deciding the duration of life imprisonment.

According to the case documents, the Appellate Division of Supreme Court on February 14, 2017, commuted death sentence of two persons convicted in murder case to life imprisonment.

But the court at the same time gave seven observations, one was life imprisonment means jail sentence until natural death of the convict.

Convict Ataur Mrida alias Ataur filed a plea to review the apex court observation and the court after holding hearing on the matter, kept the judgment on CAV today.

During the hearing, Khandaker Mahbub Hossain and Advocate Shishir Munir stood for the petitioner, while Attorney General Mahbubey Alam and Deputy Attorney General Bishwajit Debnath moved the case for the state.
