HC asks Green Line to give Russel Tk 5 lakh per month

DHAKA, June 25, 2019 (BSS) – The High Court (HC) today asked Green Line Paribahan to pay Taka five lakh monthly installment to clear the remaining Taka 45 lakh compensation to Russel Sarker, whose left leg was severed after getting crushed by one of its buses in the capital.

The High Court division bench comprising Justice FRM Nazmul Ahasan and Justice KM Kamrul Kader passed the order, asking Green Line’s lawyer to pay the installment money by 7 of each month and submit a compliance report by 15.

Earlier, Green Line Paribahan on April 10 paid Taka five lakh to Russel and was allowed one-month time to pay the remaining Taka 45 lakh fixed by the High Court.

But the transport company did not give any more money to poor Russel, as they come up with new excuses on each hearing date.

During today’s hearing, Greenline Paribahan counsel Md Oziullah pleaded to reduce the compensation amount and give them opportunity to pay the money in installments.

The High court, in response, said they cannot reduce the money as the compensation order was upheld by the Appellate Division.

The High Court (HC) on May 22 expressed discontent as Green Line Paribahan did not comply with its order of paying Taka 45 lakh as compensation to Russel Sarker.

The High Court on May 15 ordered Green Line Paribahan to pay the money to Russel by May 22.

Earlier on April 04, the High Court had extended time till April 10 for Green Line Paribahan to give Taka 50 lakh to Russel Sarker, or else not to sell any ticket from April 11.

The court came up with the order as the transport company failed to comply with the High Court direction to give the money by that day.

On March 31, the Appellate Division of the Supreme Court upheld a High Court order that had asked Green Line Paribahan authorities to give Taka 50 lakh to Russel Sarker.

The High Court later on that day, ordered the accused party to give the money by April 3.

The same High Court bench on March 12 had passed the initial order, asking Green Line Paribahan to pay the money within the next two weeks.

The court had come up with the order after hearing a petition submitted in this regard.

“Driver of that bus crushed private car driver Russel intentionally as the two logged in an altercation on Mayor Mohammad Hanif Flyover on April 28, 2018. Russel’s left leg got severed after coming under the bus,” advocate Khandaker Shamsul Haque Reza, who moved the petition, had told newsmen.

After the filing of the writ petition, the High Court on May 14, 2018, issued a rule and the court on March 12 had passed the order after holding hearing on that rule.

“The court ordered Green Line Paribahan to provide all the medical expenses for Russel and arrange fitting a prosthetic limb for him,” Advocate Reza had added.
