Govt lays great significance on ADR: Anisul
DHAKA, Aug 31, 2019 (BSS) – Law, Justice and Parliamentary Affairs Minister Anisul Huq today said the present government under the competent leadership of Prime Minister Sheikh Hasina places great significance on alternative dispute resolution (ADR).
“Apart from the Arbitration Act 2001, in the last few years some other laws have also incorporated provisions of ADR. For instance, mediation has been made mandatory in 2010 prior to holding hearing in an appropriate court by amending the Money Loan Court Act 2003. The Code of Civil Procedure 1908, introduced mediation and made it mandatory prior to hearing in the court,” he said.
The minister said these while addressing the BIAC’s 8th Anniversary Seminar on ”Effective ADR Process to Resolve Financial Disputes for a Sustainable Financial Sector” at Pan Pacific Sonargaon Hotel here in the capital.
Presided over by Bangladesh International Arbitration Centre (BIAC) chairman Mahbubur Rahman, the seminar was also attended by Commerce Minister Tipu Munshi, Legislative and Parliamentary Affairs Division Senior Secretary Mohammad Shahidul Haque, Thailand Arbitration Centre Managing Director Pasit Asawawattanaporn, Paramita Dasgupta or IFC/World Bank Group, Singapore, Professor Simon Askey of University of London, IFIC Bank Ltd Managing Director M Shah Alam Sarwar and SBK Tech Ventures Chairman Sonia Bashir Kabir, among others.
Anisul said “Though on a limited scale ADR as a method of dispute resolution has been in place in Bangladesh for quite some time. The Arbitration Act 2001 brought Bangladesh on the threshold of modern Arbitration. The Bangladesh Energy Regulatory Commission Act 2003 and the Real Estate Development and the Management Act 2010 have made provisions for arbitration. ADR has also been introduced for resolving Customs, VAT, Income Tax and Labour Law case.”
Lauding BIAC for its work to create awareness about ADR facilities, the law minister further said, “I appreciate all such initiatives of BIAC to promote practice of settlement of dispute through ADR methods. Business leaders and organisations now recognise the significance of BIAC as an institution which not only provides with suitable infrastructure for arbitration but also imparts training on ADR.”
